Terms and conditions relating to your use of Kapada Rent
Introduction:
Kapada Rent Pvt. Ltd is a private limited company incorporated under the provisions of the Company Act 2064 BS, registered under Office of Company Registrar, having office at New Baneshwor, Shankhamul road, Nepal maintains the internet portal KAPADA RENT at kapadarent.com.np. The terms and conditions set forth herein below govern the use of the site, the apps and related services provided by the company as defined below.
Agreement Period:
This Agreement begins when you first login to KAPADA RENT by logging in with Google account or by any either ways and accept it remains in effect indefinitely unless terminated as provided in the termination clause herein below.

Authority Transfer:
Being any type of user of Kapada rent you hereby grant Kapada Rent a international, royalty free, perpetual, irrevocable, non – exclusive, transferable, sub-licensable right and license to use, to distribute, copy, to reproduce, to translate, to publicly display, perform, publish subsidiaries of the content and your work and content in Kapada Rent site, Application, social media platforms along with its partners and publications in any format and media channels.
Description of services:
Kapada Rent provides users, after registration (and/or login), an access to party to the website (and/or app) through the account created to browse and take on rent the products displayed on the site (and / or app) or to purchase certain products and services listed three on web or / and app. Kapada rent shall also provide such other services, including sale of products, as may be included, removed and / or modified by Kapada rent from time to time.
Rental Period:
Rental period is the term used for the period for which a product is rented. In any rental from Kapada Rent the rental period is 3 (three) days. This includes the date in which the product is rented and the day product is returned. Extended rental period has extra fee as per the extend period which is minimum of 30% of rental fee. Any rental of product is believed to be used for one time only. Multiple use of product is subject to payment of extra fee by user that us 30% of rental fee of the same product. The rental period commences from the date of delivery of the product to the user and the product will be collected from the user on the last day of rental period. The user hereby agrees to make the product available for collection as informed by Kapada rent.
Order Placement:
All orders shall be placed by user by signing / logging in the site or in app. It is hereby clarified that Kapada rent shall have sole right to accept or reject orders placed for a product by a user. Once an order is approved by Kapada rent, the user shall be notified for confirmation of order placed by user. The ordered item shall be delivered in accordance with delivery clause. It is explicitly agreed by you that you shall not avail the service and/ or access and use the site/ app for any other purpose except for your personal use. It is hereby clarified that the products may appear different in color and style than as displayed on the site. The size and measurement may vary depending on the products.
Restriction on placement of orders:
Kapada Rent may impose limitation or restriction on the maximum number of orders placed by single user for any of the product listed on the site/app through his/her account. Kapada Rent further has the right to cancel any order placed by the user or probity any user or prohibit any user from taking on rent or purchasing any of the product listed on sale, for any reason, including but not limited to any like hood that the user, as per Kapada Rent discretion, will abuse the service or any of the reasons or circumstances specified in the cancellation clause hereunder. Users who are proven guilt by Nepali law and have criminal case are subject to non applicable to Kapada Rent services if platform identifies the clause.
Payment:
Users have to pay rental fee (rental amount) as specified on the site/app for each order along with security deposit on the site/app along with the desired/ordered product and if applicable the delivery charge as may be displayed on the site/app for each product from time to time. The security deposit shall be refunded to the user upon return of the product ordered after making deductions as may be applicable in accordance with these terms. It is agreed that Kapada Rent reserves the right to take, at its discretion any legal action if ht payment details are found to be invalid in case of credit/debit card. Kapada rent reserves the right to alter/change/enhance/reduce the rental amount anytime without prior notice to the user. All rental fee, delivery fee and security deposit are pre payment in nature. No any product is delivered without delivery fee and security deposit is paid earlier to delivery. In case of rental fee it can be paid during delivery too.
Delivery of products:
The delivery of the products of Kapada Rent is done itself or through our shipping partners, which may change from time to time. The outfit or product sent to you will be cleaned well and delivered ready to wear. We proficiently clean, sterilize and inspect each products before sending it to user, but use of the product is at your risk and Kapada Rent shall be held liable for any health relayed complaints with respect to any product. We request users not to select outfits /products that you are allergic to you. And furthermore if you have skin disease and any health problems that could transmit to other you shall avoid using shared outfits and follow the advice of Doctor. Kapada Rent shall deliver the product ordered by a user including the size, color and design on or before the delivery date. It is hereby clarified that in the event a product ordered by you is not available, Kapada Rent shall take reasonable effort to notify you of such unavailability and you shall have the right to order a replacement product. No refund is applicable on delivery fee and reservation fee on the orders made by customers under any circumstance.
Use of rented products and damages if any:
After the delivery of product to the user by Kapada Rent you have entire responsibility in relation to the use, maintenance, and safety of the product ordered by you and you agree to treat the product with most care. Until the product is returned to Kapada rent outlet any kind of damage, alternations is the sole responsibility of user. You are solely responsible for taking care of product delivered to you from loss, damage, destruction, fire, theft, alternation, disappearance, tearing, or any type of damage on product. You are liable on financial terms on any type of damage on outfit that include repair amount if the outfit is normal damage and can be made original with repair and in case of major damage and un repairable condition you are obliged to pay 120% of retail price of the outfit. It is clarified that such amount that is required to pay by you for damage of product is solely determined by Kapada Rent. You hereby agree to compensate for any minor or major damage penalties by adjusting to your security deposit or claim on your assets by Kapada Rent with Legal means is acceptable. You hereby agree not to dispute the decision made by Kapada Rent in relation to penalty set for the damage you have incurred and these terms are applicable only for the rented products only.
Cancellation of an order:
Cancellation by Kapada Rent: Kapada Rent holds right to refuse to accept order or cancel any order for any product/s or service for rent or sell made by user that are not able to deliver being no longer available for renting or sell or temporarily unavailable because of reservations by other users on same product or for any problem identified by Kapada Rent in relation to renting the product, in case of inaccuracy on details provided by user and errors detected in pricing or condition of product or other relevant information regarding color and size. Kapada Rent shall acquire relevant information form user by contact details provided by user. If any order is cancelled by Kapada Rent your payment made for the order shall be reversed back to you by the mean you have provided.
Cancellation by USER: Kapada Rent holds right to accept or reject request for cancellation for any reasons. Request to cancellation is entertained only till the time the product is not dispatched from the warehouse/store. After the product is dispatched from the warehouse/store or after the bill is issued no cancellation request is accepted. All cancellation is subject to 50% fee on displayed rental amount of product/service. In case of booking, the booking fee (which is 50% of the total product value) will not be returned to the user in case of cancellation. This is because a dress once booked by a user will not be given to other user at that period of time at any cost. It is hereby clarified that Kapada Rent shall not accept the cancellation request on purchase made by user listed on site and application. Kapada Rent holds no liability to user for citing any reason for cancellation of order made by users. The user agrees not to dispute on the decision made by Kapada Rent in relation to the determining the fee and accept Kapada Rent’s decision made in response to cancellation of order.
Return of Product:
You hereby agree and acknowledge that you are solely responsible to retune the products you have received within the rental period. If you fail to return the product within rental period you agree Kapada Rent is entitled to and authorized to charge the late fee of 30% of rental fee for each product for each day from the date of expiry of rental period. It is clarified that this amount is additional to rental amount, plus all the applicable taxes. In case the product is not returned within 7 (seven) days from the return date, Kapada Rent shall have right to charge you a late fee equivalent to an amount of 100 % of the retail price of the product (determined by Kapada Rent) plus all applicable taxes.
Return of Product without Use: Kapada Rent holds the right to accept or reject request for returns for any possible reason. Kapada Rent request users to try outfits on its outlets if possible and observe thoroughly for design, size, color and damage if any. The user is authorized to ask the delivery person to wait for up to 10 minutes and decide if s/he need the delivered product or not and if not needed user is entitled to send the product as it is the delivery person at the same time. In this case user hereby agrees to pay 30% of rental fee plus delivery fee. In case the user want to return outfit after taking from outlet or delivered product within one hour period the user is liable to pay 50% of rental fee and delivery fee. Return of product in any case after one hour time from delivery of product or receiving from the outlet is not acceptable and user is liable to pay entire rental fee.
